Article 13.--MOTOR CARRIERS

      66-1327.   Fees of issuing agents; disposition; revolving funds; bonds.Any private individual, firm or corporation designated to transmit applicationsfor, receive or issue licenses or permits by the secretary of revenue orthe secretary of transportation pursuant to K.S.A. 8-143d, K.S.A.8-1911 or 79-34,118, shall receive for such services, fees to be paid bythe secretary of revenue in an amount to be determined by the secretaryof not to exceed eight percent (8%) of the total receipts collected forlicenses or permits applied for, transmitted through or issued through suchindividual, firm or corporation. In no event, however, shall the amountof such fees be less than twenty-five dollars ($25) per month, nor shallit exceed one thousand five hundred dollars ($1,500) per month. Such feesshall be paid from the receipts collected for licenses or permits appliedfor, transmitted through or issued through such individual, firm or corporation.Those individuals, firms or corporations which collect the fees for suchlicenses or permits shall deduct from the receipts collected by such individual,firm or corporation the fees provided by this section and the balance shallbe remitted to the secretary of revenue as the secretary may direct.

      A revolving fund, designated the "permit and licensing agent fund," notto exceed ten thousand dollars ($10,000) shall be set apart and maintainedby the secretary of revenue from the license and permit fees collected pursuantto K.S.A. 8-143d, 8-1911 and 79-34,118. Such fundshall be held by the state treasurer for the prompt payment of all permitand licensing agent fees provided in this section.

      The secretary of revenue may require those individuals, firms or corporationswhich collect the fees for licenses or permits issued through them to providea bond, with good and sufficient surety, in an amount not to exceed twenty-fivethousand dollars ($25,000). The secretary shall adopt rules and regulationsnecessary to establish procedures for reporting and accounting by and theauditing of individuals, firms and corporations designated to issue licensesand permits as herein provided.
