Article 14.--RECONSTRUCTION OF BRIDGES

      68-1414.   Same; changing channel of river or erectionof structures;use of funds; bonds.Whenever it is necessary to replace, reconstruct, or repair any bridgeover any navigable river on any county road, which road connects with acounty road of another county within or outside this state, or to protectany such bridge by changing the channel of the river or by the erection ofstructures, such as levees, jetties or other structures necessary toprotect the new channel or such bridge, and which bridge shall have beendestroyed or rendered impassable by flood, high water, fire or othercasualty, then the board of county commissioners is hereby authorized andempowered to expend not to exceed the sum of $160,000 to pay the entirecost or the county'sshare of the costof such replacement, reconstruction or repair of such bridge or such changeof channel or erection of the structures hereinbefore described. No suchchange of channel shall be made without first securing the approval of thechief engineer of the division of water resources of theKansas department ofagriculture. Such expenditure may be made from any unallocated andavailable funds in the county road and bridge fund or from revenue derivedfrom the issuance of bonds, or from the separate fund for the constructionof roads and bridges on the county secondary system or from two or more ofsuch sources, and such county is hereby authorized to issue bonds for suchpurpose. Such bonds shall be issued, registered, sold, delivered andretired in accordance with the provisions of the general bond law and maybe issued without submitting the question of their issuance to a vote ofthe electors.The board of county commissioners may receive and expend any federal,state, or other funds made available for such improvement which expendituremay be in addition to the amount authorized to be expendedby the county. The provisions of K.S.A. 19-214, 19-215 and 19-216, andamendments thereto, shall beapplicable to any improvement made under the authority conferred by thissection. This act shall be construed as a separate and additional methodfor the replacement, reconstruction and repair of bridges and no other lawof this state except as herein expressly provided shall apply. The totalamount expended by any county under theauthority conferred by this section plus the amount expended by such countyunder the authority conferred by K.S.A. 68-1413, andamendments thereto, shall not exceed the sum of $160,000.
