Article 20.--TOLL ROADS OR TURNPIKES

      68-2093.   Definitions.As used in K.S.A. 68-2093 to 68-20,114, inclusive, and anyamendments thereto, the following words and terms shall have thefollowing meanings, unless the context shall indicate another ordifferent meaning or intent:

      (a)   The word "authority" shall mean the Kansas turnpike authority.

      (b)   The word "project" or the words "highway project" shall mean themodern express highways financed and constructed under the provisions ofthis act by the authority, including all bridges, tunnels, overpasses,underpasses, interchanges, entrance plazas, approaches, toll houses,service stations, and administration, storage and other buildings andfacilities which the authority may deem necessary for the operation ofsuch project, together with all property, rights, easements, andinterests which may be acquired by the authority for the construction orthe operation of such project.

      (c)   The word "cost" as applied to a highway project or projectsshall embrace the cost of construction, the cost of the acquisition ofall land, rights-of-way, property, rights, easements and interestsacquired by the authority for such construction, and the cost ofdemolishing or removing any buildings or structures on land so acquired,including the cost of acquiring any lands to which such buildings orstructures may be moved, the cost of all machinery and equipment,financing charges, interest prior to and during construction, and, ifdeemed advisable by the authority, for a period of not exceeding two (2)years after completion of construction, the funding of a debt servicereserve not in excess of two (2) years interest on the bonds, cost oftraffic estimates and of engineering and legal services, plans,specifications, surveys, estimates of costs and of revenues, otherexpenses necessary or incident to determining the feasibility orpracticability of constructing any such project, administrative expense,and such other expenses as may be necessary or incident to theconstruction of any project or projects, the financing of suchconstruction and the placing of any project or projects in operation.The word "cost" may also include amounts to be used by the authority forpaying fees and expenses of engineers for making traffic studies,surveys and estimates of cost and of revenues, legal fees and expenseswhether the same have been heretofore incurred and other expensesnecessary or incident to determining the feasibility or practicabilityof constructing highway project or projects. Any obligation or expensehereinbefore or hereafter incurred by the secretary of transportationwith the approval of the authority for traffic surveys, borings,preparation of plans and specifications, and other engineering servicesin connection with the construction of any project shall be regarded asa part of the cost of such project and shall be reimbursed to thesecretary out of the proceeds of such highway revenue bonds hereinafterauthorized.

      (d)   The words "public highways" shall include all public highways,roads and streets in the state, whether maintained by the state or byany county, city, township or other political subdivision.

      (e)   The word "bonds" or the words "highway revenue bonds" shall meanthe revenue bonds of the authority authorized under the provisions ofthis act.

      (f)   The word "owner" shall include all individuals, copartnerships,associations or corporations having any title or interest in anyproperty, rights, easements or interests authorized to be acquired bythis act.

      (g)   The words "this act" shall mean K.S.A. 68-2093 to68-20,114, inclusive, and amendments thereto.
