      71-201c.   Contracts; mandatory provisions.(a) Except as provided by subsection (c), any contractenteredinto by the board oftrustees of a community college or any of its officers or employees acting onbehalf of the boardshall contain the mandatory contract provisions prescribed by the department ofadministration inform DA-146a, as amended.

      (b)   Except as provided by subsection (c), any contract entered into after theeffective dateof this act shall be deemed to have incorporated the mandatory contractprovisions prescribed bythe department of administration in form DA-146a, as amended, even if suchprovisions are notspecifically contained in such contract.

      (c)   The board of trustees of a community college may omit any of themandatory contractprovisions prescribed by the department of administration in form DA-146a, asamended, uponthe affirmative recorded vote of a majority of the members of the board. Theboard shall nothave the authority to waive or omit from the provisions of any contract theprovisions ofK.S.A. 2009 Supp.71-201a or 71-201b, and amendments thereto.
