Article 17.--SUPPLEMENTAL RETIREMENT SYSTEMS

      72-17,102.   Same; retirement and payment on account of disability,when; limitation; medical examination; reinstatement.Any teacher or other public school employee who has been credited underthe rules and regulations of such board of education with an aggregate oftwenty-five (25) or more years of teaching experience or other employmentmay be retired by such board of education on account of disability orincapacity, physical or otherwise. Any teacher or other public schoolemployee so retired, provided that at least fifteen (15) years of suchaccredited teaching experience or other employment shall have been in thepublic schools of cities of the first class of the state of Kansas, shallbe entitled to receive from such retirement fund during the period ofretirement, monthly installments, the annual aggregate of which shall besuch percentage of one-half (1/2) of such teacher's or other public schoolemployee's average annual salary for the last ten (10) years of suchservice as the number of years of such accredited teaching experience orother employment of the beneficiary shall bear to the term of thirty years,except that no such teacher or other public school employee who is soretired shall receive more than one thousand five hundred dollars ($1,500)per annum.

      The board of education is authorized to provide for medical examinationsand to secure other evidence, at the expense of the retirement fund, forany teacher or other public school employee retired by such board ofeducation on account of disability or incapacity, physical or otherwise.Such medical examinations shall be repeated at least every year, and may beordered at any time until the beneficiary attains the age of sixty-five(65). In case any person receiving payments under this act by reason ofdisability shall recover, or if he shall refuse to be examined, thenpayments to such person from the retirement fund created by this act shallcease. In case any person receives payments under this act by reason ofbeing retired because of disability and later recovers and returns toschool service, the service record of such person shall include all schoolservice, both before and after, but not during disability.
