Article 64.--SCHOOL DISTRICT FINANCE AND QUALITY PERFORMANCE

      72-6445a.   District formed by consolidation ordisorganization; computation of state aid; time limitation.(a) (1) For the purposes of the school district finance and quality performanceact, state financial aid for any district formed by consolidation in accordancewith the statutory provisions contained in article 87 of chapter 72 of theKansas Statutes Annotated, and amendments thereto, shall be computed by thestate board of education as follows: (A) Determine the amount of statefinancial aid each of the former districts which comprise the consolidateddistrict received in the school year preceding the date the consolidation wascompleted; and (B) add the amounts determined under (A). The sum is the statefinancial aid of the consolidated district for the school year in which theconsolidation is completed.

      (2)   The provisions of this paragraph shall apply to any consolidation ofschool districts which is completed before July 1, 2011. If any of the formerschool districts had an enrollment ofless than 150 pupils on September 20th of the school year preceding theconsolidation, the state financial aid of the newly consolidated district forthe two school years following the school year in which the consolidation wascompleted shall be the greater of: (A) The amount received in the school yearin which the consolidation was completed; or (B) the amount the district wouldreceive under the school district finance and quality performance act prior toamendment by this section.

      (3)   The provisions of this paragraph shall apply to any consolidation ofschool districts which is completed on or after July 1, 2011. If any of theformer school districts had an enrollment of less than 150 pupils on September20th of the school year preceding the consolidation, the state financial aid ofthe newly consolidated district for the school year following the school yearin which the consolidation was completed shall be the greater of: (A) Theamount received in the school year in which the consolidation was completed; or(B) the amount the district would receive under the school district finance andquality performance act prior to amendment by this section.

      (4)   If all of the former school districts had an enrollment of at least 150pupils but any had less than 200 pupils on September 20th of the school yearpreceding the consolidation, the state financial aid of the newly consolidateddistrict for the three school years following the school year in which theconsolidation was completed shall be the greater of: (A) The amount received inthe school year in which the consolidation was completed; or (B) the amount thedistrict would receive under the school district finance and qualityperformance act prior to amendment by this section.

      (5)   If all of the former school districts had an enrollment of 200 or morepupils on September 20th of the school year preceding the consolidation, thestate financial aid of the newly consolidated district for the four schoolyears following the school year in which the consolidation was completedshall be the greater of: (A) The amount received in the school year in whichthe consolidation was completed; or (B) the amount the district would receiveunder the school district finance and quality performance act prior toamendment by this section.

      (6)   If the consolidation involved the consolidation of three or more schooldistricts, regardless of the number of pupils enrolled in the districts, thestate financial aid of the newly consolidated district for the four schoolyears following the school year in which the consolidation was completed shallbe the greater of: (A) The amount received in the school year in which theconsolidation was completed; or (B) the amount the district would receive underthe school district finance and quality performance act prior to amendment bythis section.

      (b) (1)   The provisions of this subsection (b) shall apply to schooldistricts which have been enlarged by the attachment of territory pursuant tothe procedure established in article 73 of chapter 72 of the Kansas StatutesAnnotated, and amendments thereto.

      (2)   For the purposes of the school district finance and quality performanceact, state financial aid for any school district to which this subsectionapplies, shall be computed by the state board of education as follows: (A)Determine the amount of state financial aid each of the former districts whichcomprise the enlarged district received in the school year preceding the datethe attachment was completed; and (B) add the amounts determined under (A). Thesum is the state financial aid of the enlarged district for the school year inwhich the attachment is completed.

      (3)   The provisions of this paragraph shall apply to any attachment ofterritory which is completed before July 1, 2011. If any of the former schooldistricts had an enrollment of less than 150 pupils on September 20th of theschool year preceding the attachment, the state financial aid of the enlargeddistrict for the two school years following the school year in which theattachment was completed shall be the greater of: (A) The amount received inthe school year in which the attachment was completed; or (B) the amount thedistrict would receive under the school district finance and qualityperformance act prior to amendment by this section.

      (4)   The provisions of this paragraph shall apply to any attachment ofterritory which is completed on or after July 1, 2011. If any of the formerschool districts had an enrollment of less than 150 pupils on September 20th ofthe school year preceding the attachment, the state financial aid of theenlarged district for the school year following the school year in which theattachment was completed shall be the greater of: (A) The amount received inthe school year in which the attachment was completed; or (B) the amount thedistrict would receive under the school district finance and qualityperformance act prior to amendment by this section.

      (5)   If all of the former school districts had an enrollment of at least 150pupils but any had less than 200 pupils on September 20th of the school yearpreceding the attachment, the state financial aid of the enlarged district forthe three school years following the school year in which the attachment wascompleted shall be the greater of: (A) The amount received in the school yearin which the attachment was completed; or (B) the amount the district wouldreceive under the school district finance and quality performance act prior toamendment by this section.

      (6)   If all of the former school districts had an enrollment of 200 or morepupils on September 20th of the school year preceding the attachment, the statefinancial aid of the enlarged district for the four school years following theschool year in which the attachment was completed shall be the greater of: (A)The amount received in the school year in which the attachment was completed;or (B) the amount the district would receive under the school district financeand quality performance act prior to amendment by this section.

      (7)   If three or more school districts, regardless of the number of pupilsenrolled in the districts, are disorganized and attached to a single district,the state financial aid of the enlarged district for the four school yearsfollowing the school year in which the attachment was completed shall be thegreater of: (A) The amount received in the school year in which the attachmentwas completed; or (B) the amount the district would receive under the schooldistrict finance and quality performance act prior to amendment by thissection.

      (8)   Except as specifically provided by this paragraph for the allocationofstate financial aid amongdistricts, the provisions of paragraphs (1) through (7) shall be applicable toschool districts to whichthis paragraph applies. If a school district is disorganized in accordance witharticle 73 of chapter72 of the Kansas Statutes Annotated, and amendments thereto, and the territoryof such district isattached to more than one district, the state financial aid for each schooldistrict to which anyterritory from the disorganized district is attached, shall be computed by thestate board of educationas follows: (A) Determine the amount of state financial aid received by theformer district in theschool year preceding the date that the disorganization and attachment wascompleted; (B) determinethe amount of state financial aid received by the enlarged district in theschool year preceding thedate that the disorganization and attachment was completed; (C) determine theassessed valuationof the former district in the school year preceding the date that thedisorganization and attachmentwas completed; (D) determine the assessed valuation of the territory attachedto each enlargeddistrict; (E) allocate the amount of the state financial aid received by theformer district in the schoolyear preceding the date that the disorganization and attachment was completedto each of theenlarged school districts in the same proportion that the assessed valuation ofthe territory attachedto each district bears to the assessed valuation of the former school district;and (F) add the amountsdetermined under (E) and (B). The sum is the state financial aid of theenlarged district for the schoolyear in which the attachment is completed.
