Article 64.--SCHOOL DISTRICT FINANCE AND QUALITY PERFORMANCE

      72-6448.   Enrollment of military pupils;determination, when.(a) As used in this section:

      (1)   "Pupil" means a person who is a dependent of afull-time active duty member of the military service or adependent of a member ofany of the UnitedStates military reserve forces who has been ordered to active duty undersection 12301, 12302 or 12304 of Title 10 of the United States Code, orordered to full-time active dutyfor a period of more than 30 consecutive days under section502(f) or 512 of Title 32 of the United States Code for the purposes ofmobilizing for war, international peacekeeping missions, national emergency orhomeland defenseactivities.

      (2)   "School year" means school year 2009-2010, 2010-2011, 2011-2012 or2012-2013.

      (b)   Each school year, the state board shall:

      (1)   Determine the number of pupils enrolled in each district on September 20;

      (2)   determine the number of military pupils enrolled in each district onFebruary 20, whowere not enrolled on the preceding September 20;

      (c) (1)   If the number obtained under (b)(2) is 25 or more, an amount equalto the numberobtained under (b)(2) shall be added to the number determined under (b)(1). Thesum is theenrollment of the district.

      (2)   If the number obtained under (b)(2) is at least 1% of the numberdetermined under (b)(1),an amount equal to the number obtained under (b)(2) shall be added to thenumber determined under(b)(1). The sum is the enrollment of the district.

      (d)   The state board shall recompute the adjusted enrollment of the districtand the generalfund budget of the school district based on the enrollment as determined underthis section.

      (e)   Districts desiring to determine enrollment under thissection shallsubmit anydocumentation or information required by the state board.
