Article 88.--CAPITAL OUTLAY LEVY, FUND AND BONDS

      72-8807.   Refraining from making authorized levy; effect.If any school district is unconditionally authorizedtomake a capital outlay tax levy, butthe board of education of such school district chooses, in any year, notto make such tax levy, or chooses to make a smaller tax levy for suchpurpose, such board of education may do so. If theboardof education of any school district refrains from making a levy in anyone or more years or refrains from making the full levy which it isauthorized to makeunder K.S.A. 72-8801, and amendments thereto, and the resolution adoptedthereunder, the authority of such school district to make a capital outlaytax levy shall not thereby be extendedbeyond the original period specified in the resolution adopted underK.S.A. 72-8801, and amendments thereto, nor shall themill rateof the tax authorized inany succeeding year be increased thereby.
