35.040 Apprehension of deserters. It shall be lawful for any civil officer having authority to apprehend offenders under the <br>laws of the United States or of any state, district, territory or possession of the United <br>States, summarily to apprehend a deserter from the National Guard or active militia and <br>deliver him into the custody of the National Guard or active militia. If an offender is <br>apprehended outside the state, his return to the area must be in accordance with normal <br>extradition procedures, or reciprocal agreements. History: Amended 1970 Ky.
