35.090 Jurisdiction of special courts-martial. (1) Special courts-martial have jurisdiction to try persons subject to this code, except commissioned officers, for any offense for which they may be punished under this <br>code, and in connection therewith, shall have the power to impose the following <br>punishments: <br>(a) Confinement not to exceed ninety (90) days; <br>(b) Fines or forfeitures of pay and allowances not exceeding one hundred dollars (&#36;100); (c) Bad conduct discharge; <br>(d) Reprimand; <br>(e) Reduction of enlisted personnel to the lowest enlisted grade; or <br>(f) A combination of these punishments. (2) A bad conduct discharge shall not be adjudged unless a complete record of the proceedings and testimony before the court has been made, and counsel qualified <br>pursuant to KRS 35.130 was detailed to represent the accused.
