38.240 Legal representation of members of National Guard. If any member of the National Guard, when on duty or assembled therefor under lawful <br>authority, does any act in the discharge of his duty that causes him to be proceeded <br>against by civil court action, the Attorney General shall represent him in the civil <br>proceedings. If, under the same conditions, a member of the National Guard is proceeded <br>against in a criminal action, the adjutant general may, with the approval of the Governor, <br>appoint legal counsel to represent him in the criminal proceedings. The compensation <br>paid the legal counsel shall be fixed by the adjutant general, with the written approval of <br>the Governor. History: Amended 1966 Ky. Acts ch. 88, sec. 3. -- Amended 1962 Ky.
