180.270 Condemnation of competing ferries. If the department is unable to contract with the owner of the competing ferry for the <br>purchase of the ferry, the department may institute condemnation proceedings in the <br>county where the ferry is located, for the purpose of acquiring the ferry. The <br>condemnation proceedings shall be in the name of the state, under the procedure set out in <br>the Eminent Domain Act of Kentucky. In the proceedings the department shall be <br>represented by the Attorney General and by the county attorney of the county in which the <br>proceedings are filed. Where the ferry operates between two (2) counties the proceedings <br>may be filed in either county. History: Amended 1976 Ky. Acts ch. 140, sec. 82. -- Amended 1974 Ky. Acts ch. 74, Art.
