206.040 Application for pension -- Procedure. (1) Applications for pensions shall be made in duplicate under oath, in the form prescribed by the cabinet, and shall be attested by two (2) reputable witnesses as to <br>the identity of the applicant. (2) The application shall be filed with the county judge/executive of the county where the claimant resides, and within thirty (30) days thereafter the county <br>judge/executive shall hear evidence in open court as to the applicant's citizenship, <br>residence and means of support. The county attorney shall be present and represent <br>the state and may produce evidence concerning any facts relative to the claim. (3) The county judge/executive shall make a finding of facts as shown by the evidence and forward his findings with a brief memorandum of the testimony of each witness <br>heard with his name and post office address, together with his own recommendation <br>upon the merits of the claim and a copy of the application to the cabinet. The <br>duplicate application shall remain on file in the county clerk's office. (4) The hearing on the application may be continued from time to time upon the motion of the applicant, but shall not be continued more than once over the objection of the <br>applicant.
