§ 13-2414. Definitions.
 

(a)  In general.- In Part III of this subtitle the following words have the meanings indicated.

(b)  Agency.- "Agency" means the county agency that the county commissioners designate to administer Part III of this subtitle.

(c)  Fund.- "Fund" means the Washington County Gaming Fund.

(d)  Gaming commission.- "Gaming commission" means the Washington County Gaming Commission.

The term "gaming commission" is substituted for the former term "Commission" to avoid potential confusion with the defined term "county commissioners". 

(e)  Tip jar.- "Tip jar" means: 

(1) a gaming device from which for consideration a number, series of numbers, or other symbol is obtained by selection of a sealed piece of paper that may entitle the purchaser to a payoff in money or otherwise, either on receipt or as the result of a subsequent announcement of a winning number, series of numbers, or other symbol; or 

(2) any other device commonly recognized as a tip jar.

In item (1) of this subsection, the former reference to the purchaser "of the number or numbers or other symbol" is deleted as implicit. 

(f)  Tip jar license.- "Tip jar license" means a license that the agency issues to operate a tip jar.

The former phrase "in the County" is deleted in light of § 13-2402 of this subtitle, which limits the application of this subtitle to Washington County. 
 

Occasionally, the term "tip jar licensee" is used in this subtitle as a synonym for a "person who holds a tip jar license". Since "tip jar license" is defined, "tip jar licensee" need not be defined separately. 

(g)  Tip jar packet.- "Tip jar packet" means a package of numbers, series of numbers, or symbols on folded or sealed pieces of paper that is designed to be sold through a tip jar and that is sufficient for a single tip jar game.

The reference to "numbers, series of numbers, or symbols on folded or sealed pieces of paper" is substituted for the former reference to "tips" for consistency with the definition of "tip jar". See subsection (e) of this section. 

(h)  Wholesaler's license.- "Wholesaler's license" means a license that the agency issues to sell or wholesale tip jar packets for profit.
