§ 11-910. Definitions.
 

(a)  In general.- In Part II of this subtitle the following words have the meanings indicated.

(b)  Board.- "Board" means the State Board of Victim Services.

(c)  Crime.-  

(1) "Crime" means conduct that is a crime under: 

(i) common law; 

(ii) § 109 of the Code of Public Local Laws of Caroline County; 

(iii) § 4-103 of the Code of Public Local Laws of Carroll County; 

(iv) § 8A-1 of the Code of Public Local Laws of Talbot County; or 

(v) except as provided in paragraph (2) of this subsection, the Annotated Code. 

(2) "Crime" does not include a violation of the Transportation Article that is not punishable by a term of confinement.

In this subsection, the former reference to conduct "that is committed by any person in the State" is deleted as implicit in the word "crime". 
 

The Criminal Procedure Article Review Committee notes, for consideration by the General Assembly, that the definition of "crime" in this subsection is cumbersome and too narrow. The definition does not apply to some crimes that are in articles other than those listed. 

(d)  Executive Director.- "Executive Director" means the Executive Director of the Governor's Office of Crime Control and Prevention.

(e)  Fund.- "Fund" means the State Victims of Crime Fund.

In this subsection, the name of the Fund is conformed to the substantive provision that creates the Fund. See § 11-916 of this subtitle. 
 

The former reference to the Fund "established under [former Art. 27,] § 854 of this subtitle" is deleted as obsolete. 

(f)  Victim.-  

(1) "Victim" means a person who suffers direct or threatened physical, emotional, or financial harm as a direct result of a crime or of a violation of § 21-902 of the Transportation Article. 

(2) "Victim" includes a family member of a minor, incompetent, or homicide victim. 
   
Special Revisor's Note.

As enacted by Ch. 10, Acts of 2001, this subsection was new language derived without substantive change from former Art. 27, § 837(f), except as it related to a family member of a minor, incompetent, or homicide victim. However, Ch. 35, Acts of 2001, amended this subsection. 
 

Paragraph (2) of this subsection was added by Ch. 35, restoring former unrevised language. Chapter 35 also deleted former subsection (g) of this section, which defined "victim's representative". 
 

The reference to "§ 21-902 of the Transportation Article" concerns driving a vehicle while intoxicated or while under the influence of drugs or alcohol. 
 

The defined term "person" was substituted by Ch. 10 for the former reference to "individual" to conform to the terminology used throughout this article.
