Oath of office and bond--penalty.

29.020. The state auditor shall not have possession orcontrol of his office until he has taken the oath of officeprescribed by the constitution, and caused the same to beendorsed on his commission, nor until he shall give the officialbond required in section 29.030; and if he shall attempt undercolor of law to do or perform any official act or duty beforecomplying with the provisions of this section, he shall forfeitfive thousand dollars for the use of the state, to be recoveredbefore any court of competent jurisdiction, without power inanyone to remit such forfeiture.
