Deputy state auditor--oath and appointment.

29.040. The state auditor shall have the power to appoint adeputy state auditor who shall be thoroughly competent to performall the duties prescribed by law to be performed by the stateauditor. Such appointment, with the oath of office endorsedthereon, shall be filed in the office of the secretary of statebefore the deputy state auditor enters upon his duties. Thedeputy state auditor, when appointed, may perform the duties ofthe office, but the state auditor and his sureties on hisofficial bond, shall be liable for the official acts, misfeasanceor defalcation of the deputy state auditor.
