Refusal to pay lawful warrant--penalty.

30.410. If the state treasurer shall willfully andunlawfully refuse to pay any warrant lawfully drawn upon thetreasury, when there is money in the fund upon which the warrantis drawn to pay the same, he shall forfeit and pay to the holderthereof fourfold the amount of such warrant, to be recovered bycivil action against the treasurer and his sureties on theofficial bond, or otherwise, according to law; and the treasurershall be deemed guilty of a misdemeanor in office.
