Convening summary courts-martial, persons authorized.

40.088. 1. In the state military forces any personauthorized to convene a general or special court-martial, thecommanding officer of a garrison, fort, post, camp, station, airbase, auxiliary air base, or other place where troops are onduty, or of a brigade, regiment, wing, group, separate battalion,separate squadron, or other detached command, may convene asummary court-martial.

2. When only one commissioned officer is present with acommand or detachment he shall be the summary court-martial ofthat command or detachment and shall hear and determine allsummary court-martial cases brought before him. Summarycourts-martial may, however, be convened in any case by superiorcompetent authority when considered desirable by him.
