40.190. After a trial by court-martial the record shall beforwarded to the convening authority, as reviewing authority, andaction thereon may be taken by the person who convened the court,a commissioned officer commanding for the time being in theabsence of the convening authority, a successor in command, anyofficer exercising general court-martial jurisdiction, or by thegovernor.
