Motor vehicle and aircraft revolving fund, purpose--exemptfrom transfer to general revenue.

43.265. There is hereby created in the state treasury the "HighwayPatrol's Motor Vehicle and Aircraft Revolving Fund", which shall beadministered by the superintendent of the highway patrol. All fundsreceived by the highway patrol from:

(1) Any source for purchase of highway patrol motor vehicles;

(2) Any source for reimbursement of costs associated with theofficial use of highway patrol vehicles;

(3) Any source for restitution for damage to or loss of a highwaypatrol vehicle or aircraft;

(4) Any other source for the purchase of highway patrol aircraft oraircraft parts; and

(5) Government agencies for the reimbursement of costs associatedwith aircraft flights flown on their behalf by the highway patrol;

shall be credited to the fund. The state treasurer is the custodian of thefund and shall approve disbursements from the fund subject to appropriationand as provided by law and the constitution of this state at the request ofthe superintendent of the highway patrol. The balances from this fundshall be used for the purchase of highway patrol motor vehicles, highwaypatrol aircraft or aircraft parts and operational costs. Any unexpendedbalance in the* fund at the end of the fiscal year shall be exempt from theprovisions of section 33.080, RSMo, relating to the transfer of unexpendedbalances to the general revenue fund.
