Powers and duties of governor.
44.022. 1. The governor shall have general direction and control ofthe state emergency management agency, and shall be responsible for thecarrying out of the provisions of sections 44.010 to 44.130. In the eventof disaster beyond local capabilities, the governor may assume directoperational control over all or any part of these emergency functionswithin this state through the director.
2. In performing duties pursuant to sections 44.010 to 44.130, thegovernor is authorized to cooperate with the federal government, otherstates, and private agencies in all matters pertaining to the emergencyfunctions of this state and the nation.
3. In performing duties pursuant to sections 44.010 to 44.130 and toeffect its policy and purpose, the governor is further authorized andempowered:
(1) To make, amend, and rescind the necessary orders, rules, andregulations to carry out the provisions of sections 44.010 to 44.130 withinthe limits of the authority conferred upon the governor pursuant to theprovisions of sections 44.010 to 44.130, with due consideration of thepolicies and plans of the federal government;
(2) To require and direct the cooperation and assistance of agenciesand officials of the state, economic and geographic areas, and localpolitical subdivisions to assist in performance of emergency functions;
(3) On behalf of this state, to enter into mutual aid arrangementswith other states, and to coordinate mutual aid plans between politicalsubdivisions, and economic and geographic areas of this state, and of thisstate and other states;
(4) To delegate any administrative authority vested in the governorpursuant to sections 44.010 to 44.130, and to provide for the subdelegationof this authority;
(5) Unless prohibited by law, any political subdivision mayappropriate funds, or contribute services, personnel and facilities tospecial committees, subcommittees or task groups organized for the economicor geographic area within which it is situated;
(6) To cooperate with the president, the Federal Emergency ManagementAgency, executive office of the president, other appropriate federalofficers and agencies, and the officers and agencies of other states;
(7) To create, establish and appoint such volunteer disaster or stateagency committees or both as may be needed to assemble and evaluateinformation which deals with emergency matters.
