Unincorporated city entitled to become third class city--mayincorporate and adopt commission form, when.

72.090. Provided, that any city or town of the state ofMissouri, not incorporated, having sufficient population toentitle it to become a city of the third class, in makingapplication for incorporation as a city of the third class, mayinclude in its petition for such incorporation a request that itbe authorized to avail itself of the provisions of sections78.010 to 78.420, RSMo, and the county commission, in passingupon such application, shall have power in its order ofincorporation to authorize said city to be governed by theprovisions of sections 78.010 to 78.420, RSMo, as fully as if theprovisions of sections 78.010 to 78.420, RSMo, had been adoptedby a formal election of the inhabitants of the territorycomprised therein; and thereupon such county commission shallappoint the officers of such city provided by sections 78.010 to78.420, RSMo.
