Allowance on accidental disability retirement.

86.077. 1. Upon retirement for accidental disability, otherthan permanent total disability as defined in subsection 2 ofthis section, a member shall receive a service retirementallowance if he has attained the age of sixty; otherwise he shallreceive an accidental disability retirement allowance which shallconsist of:

(1) An annuity which shall be the actuarial equivalent ofhis accumulated contributions at the time of his retirement; and

(2) A pension, in addition to the annuity, of sixty-six andtwo-thirds percent of his average final compensation.

2. Any member who, as the natural and proximate result of anaccident occurring in the actual performance of his duty at somedefinite time and place through no negligence on his part, ispermanently and totally incapacitated from performing any work,occupation or vocation of any kind whatsoever shall receive aretirement allowance which shall consist of:

(1) An annuity which shall be the actuarial equivalent ofhis accumulated contributions at the time of his retirement; and

(2) In addition to such annuity, a pension of sixty-six andtwo-thirds percent of his average final compensation or, in thediscretion of the board of trustees, a pension in an amount notexceeding the then prevailing compensation of a patrolman who hasserved four years or more; and

(3) An allowance, in an amount to be determined by the boardof trustees of such retirement system, to provide such memberwith surgical, medical and hospital care reasonably required,which are the result and in consequence of the accident causingsuch permanent total disability.
