Firemen, certain diseases presumed incurred in line ofduty--conditions.

87.005. 1. Notwithstanding the provisions of any law to thecontrary, after five years' service, any condition of impairmentof health caused by any disease of the lungs or respiratorytract, hypertension, or disease of the heart resulting in totalor partial disability or death to a uniformed member of a paidfire department, who successfully passed a physical examinationwithin five years prior to the time a claim is made for suchdisability or death, which examination failed to reveal anyevidence of such condition, shall be presumed to have beensuffered in line of duty, unless the contrary be shown bycompetent evidence.

2. This section shall apply only to the provisions ofchapter 87, RSMo 1959.
