Disability retirement after five years of service.

87.190. Upon the application of a member in service or ofthe chief of the fire department, any member who has had fiveyears or more of creditable service shall be retired by the boardof trustees, not less than thirty and not more than ninety daysnext following the date of filing the application on an ordinarydisability retirement allowance, if the medical board after amedical examination of the member shall certify that such memberis mentally or physically incapacitated for the furtherperformance of duty, that such incapacity is likely to bepermanent, and that the member should be retired.
