Street grading--review of commissioners' report.

88.090. The report of the commissioners may be reviewed bythe circuit court on written exceptions, filed by any party inthe clerk's office within ten days after the filing of suchreport, and the court shall make such order therein as right andjustice may require, and may order a new appraisement on goodcause shown, but the hearing of such exceptions shall be summary,and the court shall fix a day therefor without delay. And anyparty shall be entitled to have the damages assessed by a trialby jury as at common law, upon claiming the right in theexceptions to the report of the commissioners.
