Assessment of public property--street repairs (cities, under30,000).

88.790. 1. All county or other public property, cemeteriesand railroad rights-of-way shall, for the proportionate frontage,be subject to the liens of the special tax bills authorized bysections 88.777 to 88.797, as in the case of other propertysubject to the lien of said tax bills; any county or city in thisstate which shall own any public property of any kind, characteror description made subject to the lien of special tax billsauthorized by said sections shall, out of the general revenue ofsuch city or county, pay its proper proportionate share of thecost of such work and improvement authorized by said sections,and a tax bill shall be issued against such city or county, uponwhich said county or city may be sued by the owner or holder ofsaid tax bill in default of the payment thereof; but no propertyheld for public use shall be sold to enforce any such lien, andthe judgment upon any such tax bill shall be the same as anordinary judgment against cities or counties for the recovery ofmoney on contracts, and its collection shall be enforced in thesame manner as is now or may hereafter be provided by law for thecollection of judgments against such cities and counties.

2. No formality shall be required to authorize therepairing of streets or other paving, macadamizing, curbing,guttering or part thereof, and making assessments therefor, butthe proper officer or officers or committee on improvements may,with or without notice, as authorized by ordinance or resolution,cause such work to be done, keeping an account of the costthereof, reporting the same to the council for assessment;provided, that all property owned by any school district of thisstate shall be subject to the special tax provided in sections88.777 to 88.797, in the same manner as city and county propertyis subject thereto and may be collected in same manner, and theschool board of any such district shall pay such special tax outof the general fund of said district.
