When no bids received, city may construct sewer, tax bills.

88.848. Whenever the municipality advertises for bids forthe construction of a new district sewer, as provided by law, andreceives no bids therefor, the municipality may proceed toconstruct the sewer at its own expense and shall keep an accurateaccount of the amount expended for labor and materials used. Assoon as the district sewer has been completed the engineer orother officer having charge of the work shall compute the wholecost thereof and apportion the same against the lots, tracts orparcels of ground in proportion to the area of the wholedistrict, exclusive of public highways, and the officer shallreport the same to the governing body of the municipality by billor otherwise. The clerk shall issue tax bills, payable to themunicipality, against each lot, tract or parcel of ground for theamount for which it is liable. And when the tax bill madepayable to the city, town or village is assigned, themunicipality shall not be liable thereon in any court action inany manner as provided in section 88.826.
