State employees to be members--military service, effect.

104.330. 1. As an incident to his or her contract of employment orcontinued employment, each employee of the state shall become a member ofthe system on the first day of the first month following the originaleffective date of sections 104.310 to 104.540, September 1, 1957, and everyperson thereafter becoming an employee shall become a member at the time ofemployment. Each employee's membership shall continue as long as themember continues to be an employee or be on leave for military service ortraining as hereinafter provided; or receive or be eligible to receive anannuity or benefit.

2. Any member who completes military service or training on or afterDecember 3, 1974, shall receive creditable service and salary creditmandated by federal law under the Vietnam Era Veteran's Readjustment Act of1974 and the Uniformed Services Employment and Reemployment Rights Act of1994 or any successor thereto, or as otherwise provided under federal orstate law.
