Election for tax--petition--duty of county commission.

137.565. Whenever ten or more voters residing in any generalor special road district in any county in this state shallpetition the county commission of the county in which suchdistrict is located, asking that such commission submit thequestion in such district for the purpose of voting for oragainst the levy of the tax provided for in the second sentenceof the first paragraph of section 12 of article X of theConstitution of Missouri, it shall be the duty of the countycommission, upon the filing of such petition, to submit thequestion. The petition so filed shall set out the duration ofthe tax to be levied in a period of one, two, three, or fouryears and the ballot to be used for voting shall specify thenumber of years duration of the tax levy, but in no event shallthe duration of the tax levy be for a period of more than fouryears. Such submission shall be made by an order entered ofrecord setting forth the date and the rate of tax the commissionwill levy, which rate shall not exceed thirty-five cents on thehundred dollars assessed valuation on all taxable real andtangible personal property in the district.
