Rules and regulations, department to adopt--procedure.

190.185. The department shall adopt, amend, promulgate, and enforcesuch rules, regulations and standards with respect to the provisions ofthis chapter as may be designed to further the accomplishment of thepurpose of this law in promoting state-of-the-art emergency medicalservices in the interest of public health, safety and welfare. Whenpromulgating such rules and regulations, the department shall consider therecommendations of the state advisory council on emergency medicalservices. Any rule or portion of a rule promulgated pursuant to theauthority of sections 190.001 to 190.245 or sections 190.525 to 190.537shall become effective only if it complies with and is subject to all ofthe provisions of chapter 536, RSMo, and, if applicable, section 536.028,RSMo. This section and chapter 536, RSMo, are nonseverable and if any ofthe powers vested with the general assembly pursuant to chapter 536, RSMo,to review, to delay the effective date or to disapprove and annul a ruleare subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2002, shall beinvalid and void.
