Hardship grant program, distribution of, rules.

191.805. 1. Subject to appropriations, the state board of educationshall establish a hardship grant program. Hardship grants shall bedistributed to provide state supplemental funding of the federal schoolbreakfast program. Hardship grants shall be awarded to schools based on thehighest need factor. The department of elementary and secondary educationshall promulgate rules and regulations necessary for the implementation of aformula to determine need factor, and such rules and regulations shall beconsistent with federal guidelines for the school breakfast program asauthorized by 42 U.S.C. 1773.

2. Any school that participates, or is eligible to participate, in thefederal school breakfast program may apply for a hardship grant. The combinedamount received by a school from the federal school breakfast program and thehardship grant shall not exceed the cost of the actual operation of the schoolbreakfast program.

3. No money from the public school fund shall be used to providehardship grants.
