198.064. 1. No operator shall retain any duplicate paymentfor the care of a resident received from any state agency oragencies. For the purposes of this section a duplicate paymentis one which results in a total payment to the operator in excessof the per diem or monthly rate authorized by the agency oragencies. The operator shall report all such duplicate paymentsto the paying agency or agencies within five business days aftersuch duplicate payment is discovered or reasonably should havebeen discovered.

2. The operator shall repay the excess amount in accordancewith such procedures as the paying agency or agencies shallreasonably require, together with interest at the rate of one andfive-tenths percent per month from the date the duplicate paymentwas discovered or reasonably should have been discovered.
