Kickbacks, bribes and rebates prohibited, when.
198.145. A person shall not purposely solicit or receive anypayment, including, without limitation, any kickback, bribe orrebate, directly or indirectly, overtly or covertly, in cash orin kind, from any vendor or health care provider:
(1) In return for referring an individual to a person forthe furnishing or arranging for the furnishing of any item orservice for which payment may be made in whole or in part underMedicaid; or
(2) In return for purchasing, leasing, ordering or arrangingfor or recommending purchasing, leasing or ordering any good,facility, service or item for which payment may be made in wholeor in part under Medicaid.
