Medical assistance, payments withheld for services, when--paymentordered, interest allowed.

208.165. The department or its designated division shallhave authority after forty-five days written notice to theaffected provider to withhold from any payments that may be orbecome due to a provider of service under the medical assistanceprogram such amounts as the department or its designated divisionmay determine are due to the state as a result of overpayments,cost settlements, disallowances, duplicate payments, fraud orabuse; provided that should a judicial tribunal, including theadministrative hearing commission, finally determine that all orpart of such withholding is due to the provider of services, thejudicial tribunal may, in its discretion, allow a reasonable rateof interest on such amount from the time of the withholding.
