Rules, effective when, invalid when.

208.657. Any rule or portion of a rule, as that term is defined insection 536.010, RSMo, that is promulgated under the authority delegated inthis chapter shall become effective only if the agency has fully compliedwith all of the requirements of chapter 536, RSMo, including but notlimited to, section 536.028, RSMo, if applicable, after August 28, 1998.All rulemaking authority delegated prior to August 28, 1998, is of no forceand effect and repealed as of August 28, 1998, however, nothing in sections208.631 to 208.657 shall be interpreted to repeal or affect the validity ofany rule adopted or promulgated prior to August 28, 1998. If theprovisions of section 536.028, RSMo, apply, the provisions of sections208.631 to 208.657 are nonseverable and if any of the powers vested withthe general assembly pursuant to section 536.028, RSMo, to review, to delaythe effective date, or to disapprove and annul a rule or portion of a ruleare held unconstitutional or invalid, the purported grant of rulemakingauthority and any rule so proposed and contained in the order of rulemakingshall be invalid and void, except that nothing in sections 208.631 to208.660 shall affect the validity of any rule adopted and promulgated priorto August 28, 1998.
