214.150. The county commissions of the respective countiesof this state shall become trustees and custodians of any fund orfunds which may be created by any person or persons, firm orcorporation, for the purpose of maintaining in part or in wholeany public or private cemetery in their respective county. Whena gift or bequest is made to said county commission they shallaccept the same upon the terms and conditions of said gift orbequest and administer said trust fund as herein provided andmake report to the circuit court annually showing in detail themanner in which said trust fund or funds have been managed.

(1957) Sections 214.150 to 214.180 authorize but do not compel county courts to act as trustees and custodians of trust funds for maintenance of cemeteries and such courts are required to administer such funds only when so designated by the trustor. Powers v. Johnson (A.), 306 S.W.2d 616.
