Highways and transportation commission may convey or exchange land orleasehold.

227.290. 1. Whenever in the opinion of the state highways andtransportation commission the advantageous use of any interest in land orany leasehold which has heretofore or may hereafter be acquired by thecommission has ceased, or for any other lawful reason the commission wishesto dispose of the property, the commission shall have authority to conveyor exchange such interest in land or leasehold for its approximate fairmarket value pursuant to any administrative procedure or process asdetermined by the commission, by deed signed by its chair or vice chair andattested by its secretary. Before any sale shall be consummated under thissection, the original owner of the property which is now offered for saleby the commission and if such owner shall at the time of sale be inpossession of the adjoining land, shall be notified by written notice bythe department of transportation of such contemplated sale. All moneysreceived from the disposal of any such interest in land or leasehold shallbe deposited by the commission in the state treasury to the credit of thestate road fund. Any land or leasehold herein described that has beendonated without charge by the owner to the purpose of state highwayconstruction or maintenance and such owner is still in possession ofcontiguous property, the same shall revert to such original owner withoutcost to the owner if and when relinquished by the commission.

2. The commission may also, in its discretion, convey at no cost, orexchange its interest in any land or leasehold that is no longer necessaryto be used for the construction, maintenance, or operation of the statehighway system, or for any other lawful reason, to any federal, state, orlocal governmental entity.
