Commissioners may contract for removal of minerals and forrebuilding of road abandoned.

229.430. The commissioners of any special road districtwhere said road is located, or the township board if said road benot in a special road district, whenever in their opinion theremoval of said coal or other valuable mineral from under thesurface of said road and the rebuilding of said road will be apublic benefit, may with the approval and consent of the countycommission enter into a contract with any responsible person,firm or corporation for the removal of said coal or other mineraland for the rebuilding of said road under such terms andconditions as in their opinion are fair and just.
