Commissioners, appointment of, terms--requirements--vacancies.

233.505. 1. At the meeting of the county commission inwhich such order is made, or at any subsequent meetingthereafter, the county commission shall appoint three specialroad subdistrict commissioners, who shall be voters of thesubdistrict who shall hold their office until the second Tuesdayin April thereafter. The voters of the subdistrict, at an hourand place to be fixed by the commissioners, shall elect threespecial road subdistrict commissioners, one of whom shall serveone year, one for two years, and one for three years, and onmunicipal election days each year thereafter they shall elect aspecial road subdistrict commissioner to take the place of theone whose term is about to expire, who shall serve for threeyears.

2. No person shall be elected or appointed as acommissioner who is not a voter of the subdistrict. Any vacancycaused by resignation, death, removal from the subdistrict of aspecial road subdistrict commissioner or sale of all land ownedby him in the subdistrict shall be filled for the unexpired termby appointment by the remaining special road subdistrictcommissioners of the subdistrict. All special road subdistrictcommissioners shall qualify by taking, subscribing and filingwith the county clerk the oath prescribed by the constitution ofthis state, and that they will faithfully, honestly andimpartially discharge their duties as commissioners according tolaw.

3. If for any reason the board of commissioners shall failto call an annual election to fill a vacancy or vacancies causedby the expiration of the term of any one or more of the specialroad subdistrict commissioners, then the county commission ishereby authorized and required to call an election to fill suchvacancy.
