Cities and counties may contract for free public highways overbridges, procedure.

234.100. Any city organized under general law, or underspecial charter, or under section 19 of article VI of theconstitution of this state, and adjoining a navigable stream andseparated by such stream from a county of this state adjoiningsaid stream opposite said city, and the county commission of anysuch county, may unite in purchasing, for a free public highwayfor travel between such city and such county by wagons, vehicles,footmen and animals right-of-way over any bridge or bridgescrossing such stream and connecting such city and such county andbeing maintained and used as a toll bridge for wagons, vehicles,footmen, passengers and animals, and for other purposes, or incontracting with any holder of a franchise; for construction ofa proposed bridge across such stream and to connect such city andsuch county, and for maintenance of such bridge as a toll bridgefor wagons, vehicles, foot passengers and animals, and for otherpurposes, for the purchase, upon completion of such proposedbridge, of right-of-way thereon for a free public highway fortravel between such city and such county by wagons, vehicles,footmen and animals; the cost of any right-of-way so purchased orcontracted for to be defrayed by such city and such county, eachpaying such portion thereof as may be agreed upon between suchcity and such county commission; and whenever the owner of anysuch bridge shall in writing propose to sell such a right-of-wayover such bridge, or the holder of any such franchise shallpropose to contract with any such city and county for the sale,upon completion of the proposed bridge, of such a right-of-waythereon, said county commission shall appoint a commission,composed of the county surveyor or highway engineer, and twoowners of real estate in the county, who shall confer with themayor or other chief officer of such city and the owner of suchbridge or the holder of such franchise, and ascertain and reportto the county commission the price for which such right-of-waycan be purchased or contracted for, and whether such price isreasonable, and the portion of such price that such city proposesto pay; which report shall be filed with such county commission,and if such price is for right-of-way over such a proposedbridge, such committee shall procure and file with such report acopy of the plans for such proposed bridge.
