Insurance, district may obtain--purposes--self-insurance notallowed, exception.

238.255. 1. The district may obtain such insurance as itdeems appropriate, considering its legal limits of liability, toprotect itself, its officers and its employees from anypotential liability and may also obtain such other types ofinsurance as it deems necessary to protect against loss of itsreal or personal property of any kind. The cost of thisinsurance shall be charged against the project.

2. The district may also require contractors performingconstruction or maintenance work on the project to obtainliability insurance having the district, its directors andemployees as additional named insureds.

3. The district shall not attempt to self-insure for itspotential liabilities unless it finds that it has sufficientfunds available to cover any anticipated judgments orsettlements and still complete its project without interruption.The district may self-insure if it is unable to obtain liabilityinsurance coverage at a rate which is economically feasible tothe district, considering its resources.
