County commissions may cancel contracts, upon conditions.

241.170. In every case where persons have become thepurchasers of swamp and overflowed lands in the several countiesin this state, on credit, either in whole or in part, and shall,by death or otherwise, become unable to pay for the same, thecounty commission of such county, on the application of suchpurchaser, or, in case of death, of his or her legalrepresentatives, is hereby authorized to cancel the contract, inwhole or in part, upon these conditions: The said commissionshall not, in any case, pay back any money or interest that hasbeen paid upon said contract, nor rescind a contract for timberedland, when the timber or any portion of it has been removed sincethe sale of said land by said commission, without full indemnitybeing made therefor; and whenever any such sale is canceled thecounty commission may resell said land as provided in section241.160.
