Compensation--appointment of special commissioners and surveyor.

244.110. 1. The parties petitioning shall be liable for allcosts incurred on account of any proceeding under this chapter.Each commissioner shall receive for his services two dollars foreach day employed and necessary expenses incurred in additionthereto; any surveyor for services rendered while working underthe direction of the commissioners shall be paid three dollarsper day and all necessary expenses.

2. In case it becomes the duty of the circuit court to havethe work constructed, as is provided for in section 244.090, saidcourt shall have the right to appoint a special commissioner, whomay or may not be a surveyor, and not owning land that isaffected in any way by the works, to take charge of theconstruction and report to said court from time to time as to theprogress of said construction and make a full report when thesame has been completed. Such commissioner shall, uponcompletion of the work, make a final report to the court, andsaid court shall, if it finds said work performed according tocontract, accept and confirm said report.
