Construction or improvement of levees to protect lands in otherdistricts--procedure--costs, how paid.
245.483. Whenever the board of directors of any districtorganized under sections 245.285 to 245.545 shall determine thatthe levees constructed by the district are insufficient from anycause to afford complete protection from overflows to the landsin the district, and whenever any such board determines that theconstruction of an additional levee or levees or the enlargingand strengthening of the existing levee or levees within thedistrict would also afford additional protection to landssituated in another levee district or districts organized undersections 245.285 to 245.545, the board of directors may proceedto cause surveys, maps, and profiles of the proposed work ofimprovement and estimates of the cost of the work to be made bysome experienced and competent engineer who shall make a writtenreport, showing the amount, character, and kind of work to bedone, the exact location and probable cost thereof, and returnthe same with all plans and specifications to the board ofdirectors. Upon receipt of the report of the engineer andapproval thereof by the board of directors, the board may directthat copies of the report be forwarded to the board of directorsof each such other levee district, with the request that eachsuch other board meet in joint session with the board ofdirectors of the district in which the improvement is to beconstructed for the purpose of determining the proportionateshare of the cost of the improvement which should be borne byeach district involved. When all such boards, in joint session,shall have agreed upon the proportion of the cost to be borne byeach district involved, the board of each district shallthereupon proceed in the same manner as is now provided insection 245.480 to call a landowners' meeting and to levy anadditional tax and an additional percent of the assessed benefitsexpended for such purpose. Any proposal to levy an additionaltax as provided in this section shall be approved by a majorityin each district involved to become effective. The proceeds ofany additional tax or the proceeds of any bonds which may beissued by any district for the purpose authorized in this sectionshall be transmitted to the treasurer of the levee districtwithin which the contemplated improvements are to be constructed,and shall be placed in a separate fund and shall be used for noother purpose than to construct such improvements. Any sumremaining in the fund after the completion of the improvementsshall be returned to the participating districts in proportion tothe amount contributed by them. Any such board of directorsshall have power to give such notice of the landowners' meetingas it may deem proper, in addition to the notice required bysection 245.460.
