Sewer district organization--petition for.

249.010. Whenever the construction and maintenance of asystem of sewers or the use of existing sewers for any contiguousarea in the state of Missouri shall become necessary for thepreservation of the public health or public welfare or will be ofpublic utility or benefit, if any such area shall lie within anycounty in the state of Missouri, now or hereafter having apopulation of not less than seven hundred thousand nor more thanone million inhabitants, the area may be established andincorporated as a sewer district under sections 249.010 to249.420 in the manner following: Twenty-five or more votersresiding within the area may file with the circuit court havingjurisdiction, a petition setting forth therein the reason ornecessity for a sewer system; the boundary lines of the proposeddistrict; the type and/or kind of sewers; the name of theproposed district, and the number of years the district is tocontinue; a request for the appointment of a sanitary engineerwith duties as herein provided; and take any further actionnecessary to determine the question whether the area may beorganized and incorporated as a sewer district under sections249.010 to 249.420. There shall be filed with the petition abond in a sum to be determined by the court but in no event morethan five hundred dollars payable to the state of Missouri signedby one or more of the petitioners with good and sufficient suretyor sureties to be approved by the court, conditioned for thepayments of costs and expenses.
