Contracts, procedure for letting--concessions, how granted.

257.250. Whenever the board of trustees lets contracts fornecessary works or concessions, it shall be governed as follows:

(1) Contracts let for necessary works may be either as awhole or in parts, except that for works costing over fivethousand dollars the board shall advertise and award same by opencompetitive letting and public contract as hereinafter provided:

(a) Advertisements calling for bids shall be published, oncea week for three consecutive weeks, completed on date of lastpublication, in at least one newspaper of general circulationwithin the district.

(b) The board may let the contract to the lowest or bestbidder having adequate experience, skill, plant equipment andresponsibility and who shall give a good bond and sufficientbond, with a reputable surety company as security conditioned onthe carrying out of the contract.

(c) Contracts shall be in writing and shall be accompaniedby or shall refer to plans or specifications for the work to bedone, or materials, services or equipment to be furnished. Allcontracts shall be approved by the board of trustees and signedby a designated officer-trustee of the board and by thecontractor, and shall be executed in duplicate.

(d) In case of a sudden emergency when it is necessary inthe opinion of the board, in order to protect life or propertywithin the district, the advertising of the contracts may bewaived upon the consent of a majority of the board of trustees.

(2) Concessions may be granted or leased on, along, orbetween properties of the district for businesses serving peopleusing the resources or facilities of the district, for definiteperiods, whenever the board deems it for the best interest andgeneral welfare of the district. All sums so collected shall beplaced in the general fund. No concession or privilege shall begranted or leased without public notice and competitive biddingtherefor submitted in writing and accepted by the board oftrustees, all in the same manner as provided in this section forcontracts for necessary works.
