Demonstration awards--technology and strategy in food and fiberproduction--rule authorization, procedure.

261.105. 1. The department of agriculture shall make demonstrationawards, out of appropriations made for that purpose, to the center forsustainable agricultural systems of the University of Missouri college ofagriculture for the development and coordination of demonstration projects onthe lands of individual farmers in this state which identify, develop anddemonstrate agricultural technologies and farm management strategies in foodand fiber production carried out under actual farming conditions that willreduce the dependency of food and fiber production on nonrenewable inputs. Inany one fiscal year, no more than* thirty such demonstration project awardsshall be made and no award shall exceed four thousand five hundred dollars forany one demonstration project. The department of agriculture, in cooperationwith the University of Missouri college of agriculture and the University ofMissouri extension service, shall promulgate rules and regulations necessaryto carry out the provisions of this section and for the identification ofdemonstration projects and award areas. The demonstration projects shall beselected on a broad geographical basis so that each agricultural area of thestate is represented as nearly as practicable. The demonstration projectsshall be selected on the basis of innovative practices based on competitiveapplications received. Each demonstration project shall be monitored by theUniversity of Missouri extension service and a report of the project shall bemade to the department of agriculture.

2. No rule or portion of a rule promulgated pursuant to the authority ofthis section shall become effective unless it has been promulgated pursuant tothe provisions of chapter 536, RSMo. Any rule or portion of a rule, as thatterm is defined in section 536.010, RSMo, that is promulgated under theauthority delegated in this section shall become effective only if it has beenpromulgated pursuant to the provisions of chapter 536, RSMo. Nothing in thissection shall be interpreted to repeal or affect the validity of any rulefiled or adopted prior to August 28, 1999, if it fully complied with theprovisions of chapter 536, RSMo. This section and chapter 536, RSMo, arenonseverable and if any of the powers vested with the general assemblypursuant to chapter 536, RSMo, to review, to delay the effective date or todisapprove and annul a rule are subsequently held unconstitutional, then thegrant of rulemaking authority and any rule proposed or adopted after August28, 1999, shall be invalid and void.
