Department of agriculture to develop standards and labeling fororganic farming--rulemaking authority.

261.110. 1. The department of agriculture shall develop standardsand labeling for organic farming.

2. The department of agriculture shall adopt rules to implement theprovisions of this section.

3. The department may cooperate with any agency of the federalgovernment, any state, any other agency in this state, any private entityor person engaged in growing, processing, marketing of organic products, orany group of such persons in this state, in programs to effectuate suchpurposes. Such agreements may provide for cost and revenue sharing, andfor division of duties and responsibilities under this section and mayinclude other provisions generally to effectuate the purposes of thissection.

4. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2002, shall beinvalid and void.
